Introduction
Welcome to travelfab.co.uk. This website is owned and operated by Travel Fab Limited, trading as Travelfab, of China Works, 100 Black Prince Road, Vauxhall, London, SE1 7SJ, United Kingdom. In these terms, "we", "us" and "our" mean Travel Fab Limited.
We are an independent, privately owned tour operator, registered as a limited company in England and Wales under company number 08910640. We hold Air Travel Organiser's Licence (ATOL) number 10898, issued by the Civil Aviation Authority. Our VAT number is GB184616292.
These Terms and Conditions apply to every trip booked with us, online or over the telephone. By booking with us you accept them, so please read them carefully, because they are legally binding. In these terms, "you" means the person who makes the booking and every member of the party added to it at any time.
We sell flights, and holidays that include a flight sold by us. We do not sell land-only or accommodation-only arrangements. Every booking you make with us therefore includes a flight that we sell, and is financially protected under our ATOL.
The Package Travel and Linked Travel Arrangements Regulations 2018 give you a set of key rights when you buy a package from us. We give you the standard information about those rights before you book, and you can read it at any time here: Your key rights when you book a package.
1. Your Financial Protection
Travel Fab Limited, trading as Travelfab, holds Air Travel Organiser's Licence number 10898.
When you buy an ATOL protected flight or flight inclusive holiday from us you will receive an ATOL Certificate. This lists what is financially protected, where you can get information on what this means for you and who to contact if things go wrong.
We, or the suppliers identified on your ATOL Certificate, will provide you with the services listed on the ATOL Certificate (or a suitable alternative). In some cases, where neither we nor the supplier are able to do so for reasons of insolvency, an alternative ATOL holder may provide you with the services you have bought or a suitable alternative (at no extra cost to you). You agree to accept that in those circumstances the alternative ATOL holder will perform those obligations and you agree to pay any money outstanding to be paid by you under your contract to that alternative ATOL holder. However, you also agree that in some cases it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL scheme (or your credit card issuer where applicable).
If we, or the suppliers identified on your ATOL Certificate, are unable to provide the services listed (or a suitable alternative, through an alternative ATOL holder or otherwise) for reasons of insolvency, the Trustees of the Air Travel Trust may make a payment to (or confer a benefit on) you under the ATOL scheme. You agree that in return for such a payment or benefit you assign absolutely to those Trustees any claims which you have or may have arising out of or relating to the non-provision of the services, including any claim against us, the travel agent (or your credit card issuer where applicable). You also agree that any such claims may be re-assigned to another body, if that other body has paid sums you have claimed under the ATOL scheme.

2. Contract
All bookings are subject to availability. Before a booking is taken, full details of your proposed trip will be advised to you. Once you have confirmed that you are happy with the proposal, we will take payment and issue you a booking confirmation. Please check that all names are the same as the relevant passport, that dates and timings and all other elements of your trip are correct. Where this is not done, and there is an unreasonable delay in notifying any apparent discrepancies in the confirmed arrangements, you will be responsible for any additional charges that may arise due to alterations that have to be made to the booking.
A binding contract between you (the lead name on the booking) and us is only formed when we issue our booking confirmation (by email or post) after having received payment from you, in cleared funds, of either the required deposit or the total price of your holiday (depending on when the booking is made relative to the intended departure date). By making the booking, you accept that you have the authority to bind all members of your party to these terms and conditions of booking. You take responsibility as the lead name on the reservation to make payment and receive documentation on behalf of your party.
3. Price and Payment
We reserve the right to alter the costs of any trips shown on our website or set out in our written proposal to you at any time before you make a booking. You will be advised of the current price before your booking is confirmed. Prices quoted are GBP sterling prices based on daily currency exchange rates prevailing at the time of quotation. Please note that all payments taken on a debit or credit card will be made in GBP sterling. So if you are a customer whose payment card is not denominated in GBP, the final price will be calculated following the applicable exchange rate on the day your card issuer processes the transaction. Wherever possible, we could accept PayPal payments; our sales representative will confirm the validity of this.
In all cases, to make a booking, a deposit will be required. The amount of deposit varies depending on the nature of your trip and will be confirmed to you before you book. Where bookings include flights with airlines that require full payment in advance of booking, the total price of the airline(s) ticket will be included in the booking deposit. It will be chargeable in the event of cancellation (see below). The balance payment is due ten weeks in advance of the intended departure date. For some trips, for example flight-only bookings or trips built around an airline fare with its own ticketing deadline, we will confirm a different balance date in your booking confirmation, in most cases 40 days before departure, so that we can issue your flights and make sure everything is ready for your arrival. Where your booking confirmation shows a later balance date, that date applies, including for bookings made less than ten weeks before departure. If the booking is made less than ten weeks before departure, the total price of the trip will be payable on booking. If following the payment of a deposit at the time of booking, any balance remains unpaid within ten weeks of the intended departure date, we reserve the right not to issue travel documentation and treat your booking as cancelled. In such circumstances, cancellation charges will be applied as set out below.
Payment must be made in the currency of the invoice, and you will be responsible for any bank charges that may be incurred. Payment can be made by cheque paid into our account, bank transfer, debit card. In all cases, a booking will not be confirmed until we receive cleared funds. We reserve the right not to accept credit cards as the merchant account provider still charging us for any transactions that we have via card payments when your deposit and balance payments are made. For your peace of mind, our payment site is protected, and all card payments are encrypted using the internationally accepted security system, SSL.
Changes to the Price After You Book
Once we have issued your booking confirmation, the price of your trip can only change for one of three reasons: a change in the cost of carrying passengers resulting from the price of fuel or other power sources; a change in the level of taxes or fees charged by third parties who are not directly involved in performing your package, including tourist taxes, landing taxes and embarkation or disembarkation fees at ports and airports; or a change in the exchange rates relevant to your package. No other change allows us to alter the price.
We calculate any change by taking the difference between the cost we used when we priced your trip and the cost that applies when we recalculate it, and applying that difference to the affected part of your package only. We do not add any margin or mark-up to it.
If those costs rise, we may pass the increase on to you. If they fall, we will pass the reduction back to you, less any administrative expenses we have actually incurred, and we will refund the difference.
We will not increase the price within 20 days of your departure date. If we do need to increase it before then, we will tell you in writing, explain the reason, and show you the calculation.
If an increase would be more than 8% of the total price of your package, you may accept it, accept a substitute trip if we are able to offer you one, or cancel your booking and receive a full refund of everything you have paid. We will set out a reasonable period in our notice for you to tell us which you choose.
4. Insurance
Adequate travel insurance is essential, and we strongly recommend you arrange it as soon as your booking is confirmed, so that you are covered from that moment for cancellation as well as for medical costs, repatriation and lost baggage while you are away.
Please check that your policy covers everything in your itinerary. Cover that is fine for a beach holiday is often not enough for walking at altitude, small boats and internal flights, diving, riding, or travel in remote areas, and some policies treat Foreign Office advice in ways that would leave you uninsured.
We can tell you what to look for, but we do not check your policy and we do not make cover a condition of your booking. If you choose to travel without adequate insurance you do so at your own risk. We will not be responsible for any costs incurred by you or anyone in your party, before, during or after your trip, that would have been recoverable under an adequate policy.
5. Passports, Visas and Health Requirements
Before you book, we will tell you the passport, visa and health requirements that apply to British citizens for the destinations in your trip, and we will confirm them in writing with your booking. If you hold a passport issued by another country, please tell us, because different requirements may apply. Most countries require a passport that is valid for at least six months after your return date. Airlines also require photographic identification of a specific type for all air travel, so please ask us for details.
Ultimately, it is your responsibility to ensure that you and your party will obtain, and will have, all necessary travel documents/visas in advance of travel. It will also be your responsibility to ensure that you and all members of your party comply with all health requirements for the destination concerned. We will not accept liability if you or any member of your party is refused entry onto any transport or into any country due to failure on your/their part to carry correct documentation or to comply with relevant health requirements. If you or any member of your party have any disabilities, we must make the necessary arrangements to make your holiday go smoothly. We must, therefore, insist that you contact our offices before completing any reservation to ensure compatibility for the holiday that you choose.
6. Information
While we make every effort to ensure that the information on our website is accurate and not misleading, it may have been published many months before your trip takes place and may be subject to change. We reserve the right to make changes to the website and any information it contains at any time. Where material changes are made that affect your trip after your booking has been confirmed, please see section 7 below.
7. Amendment and Cancellation by You
Any cancellation or amendment request must be sent to us in writing and will not take effect until received by us.
(a) Amendment
If, after our booking confirmation has been issued, you wish to change your travel arrangements in any way, we will do our best to assist you in amending your reservation after booking. Still, we cannot guarantee that this will be possible. Any request for changes must be in writing from the person who made the booking. You will be asked to pay an administration charge of £75 and any further costs we incur in securing those alterations.
We reserve the right to treat any amendment notified to us less than eight weeks before the date of departure as a cancellation and, in such circumstances, will require you to pay to us the cancellation charges set out in Section 7(b) below. If you or any member of your party is prevented from going on your confirmed trip for reasons beyond your control, for example, the death of a close relative or jury service, you/they have the right to request the transfer of your/their booking to another person, subject to our prior approval. These terms and conditions of booking will bind such a person. Where you, as the lead and contracting member of your party, are unable to travel, and another person takes your place, that person will assume the role of principal and contracting member of the party unless you notify us to the contrary.
In all cases where a member or members of the booking party are substituted with others, we reserve the right to charge an administration fee of £75 per name change in addition to any other charges that we may incur in making the amendments. Please note that in many cases, scheduled airlines apply 100% cancellation charges and will not permit name changes or other booking alterations to be made. If you and any member of your party are considering altering your reservation in any way, please get in touch with our staff, who will notify you of the applicable charges.
In addition to amendment and cancellation charges that we apply, you will be responsible for any increased costs arising from changes to accommodation arrangements and room occupancy levels that you wish to make.
(b) Cancellation
You, or any member of your party, may cancel your travel arrangements at any time. The cancellation will take effect from the date that we receive written notification of cancellation from you. We will accept notice of cancellation by email on the understanding that you agree and acknowledge that where you are shown as the sender of the email, we will be entitled to assume that you have sent such email. Booking cancellations may incur cancellation charges depending on how much notice you give us before the departure date. If you cancel more than ten weeks before your intended departure date, this charge is likely to be the amount of your deposit (including any increased deposit payable as a result of the booking of scheduled flights, see above) although it could be more. Charges for cancellation after the balance due date will usually be more than the deposit amount and will vary due to the complex nature of our travel itineraries. Cancellation charges are likely to increase closer to the departure date that the cancellation is made and may well be up to 100% of the total price of your booking, and you should contact us as soon as possible. Cancellation charges for your trip can be confirmed to you on request at any time, including before booking.
Cancellation charges:
- 56 days or more before departure: Issued flights are not refundable. You will lose your deposit. The outstanding balance is fully refundable.
- 56 - 40 days before departure: 80% of the total booking cost
- 40 days - Travel Date: 100% of the total booking cost
The charges above are a maximum. We will never charge you more than your deposit plus what your cancellation has actually cost us beyond it: the money we have paid to airlines, hotels and other suppliers and cannot get back, the money we are committed to pay them for your booking and cannot now avoid, the cost of any flights already issued, and our reasonable administration costs. Your deposit is kept in every case, because it pays for the work of designing your trip and holding it for you, which we have already done by the time you book. Where the total comes to less than the percentage shown above, you pay the lower amount. Where you have already paid us more than that, we will refund you the difference within 14 days. Please ask for confirmation of the amount of any cancellation charge before your written or email cancellation request. Please note that if the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim some or all of the cancellation charges. Please speak to your insurance provider.
In all cases where cancellation results in us making a refund payment to you, such fee will be made to you as the lead and contracting member of your party, or any substitute leads and contracting member of the party (see above). This will be the case regardless of which members of the party making the deposit and balance payments for the booking. Whenever a refund is due to you under these conditions, for any reason, we will pay it within 14 days.
8. Amendment and Cancellation by Us
(a) Amendments Before Departure
We may have to make amendments to the trips advertised as these are booked many months in advance. We can do this at any time, and we will advise you of any changes that affect your booking before it is confirmed. Occasionally, it is necessary for us to make changes after your reservation has been confirmed. If the difference is material (for example, a change of flight time by more than 12 hours, change of carrier, change of destination or change of accommodation to one with a lower official rating), we will notify you as soon as practically possible and offer you the choice of (i) accepting the amended arrangements; (ii) arranging an alternative trip of comparable standard if available with us; or (iii) cancelling your trip and receiving a full refund of all monies paid. Regardless of the option you choose, we will pay you compensation for material changes as set out in the table below, except where such change has been caused by a Force Majeure Event (as defined in Section 8(d)).
Compensation for material changes by us:
- 56 days or more before departure: Nil
- 56 - 40 days: £10
- 40 - 28 days: £20
- 27 - 14 days: £40
- Less than 14 days: £50
The compensation that we offer does not exclude you from claiming more than you are entitled to.
If the change is minor, we will do our best to notify you in advance of departure, but we are not obliged to do so, and no compensation will be payable.
(b) Amendments During Your Trip
If we are unable to provide a significant proportion of your trip while you are away, suitable alternative arrangements will be made for you at no extra cost for the continuation of your journey, and we will where appropriate, compensate you for the difference between the services contracted for and those supplied. If it is impossible to make such alternative arrangements or these are not accepted by you for good reasons, we will give you the option to return to your point of departure or another place to which you have agreed (subject to flight/transport availability). We will, where appropriate, compensate you. This does not apply to minor changes in your accommodation, itinerary or transportation arrangements.
(c) Cancellation
While we hope we will never have to cancel your trip, this is very occasionally necessary, and we reserve the right to do so. We will do our best to offer alternative arrangements of a comparable or better standard, with any appropriate refund, or we will give you a full and prompt refund of the price of the trip. We will also pay you reasonable compensation, unless the reason for the cancellation is a Force Majeure Event (see (d) below), or unless we told you that the trip needed a minimum number of bookings and we did not receive them.
Where a trip needs a minimum number of bookings to run, we will tell you that number, and the date by which it must be met, before you book. If we have to cancel for that reason we will tell you no later than 20 days before departure for a trip lasting more than six days, 7 days before departure for a trip lasting between two and six days, and 48 hours before departure for a trip lasting less than two days. We will then refund everything you have paid.
(d) Force Majeure
Compensation will not be payable in any cases where an amendment, change, or cancellation is due to an unusual or unforeseeable event, or circumstance beyond our reasonable control including, but not limited to, war, the threat of war, riot, civil disturbance or strife, terrorist activity (actual or threatened), industrial disputes, technical or maintenance problems with transport, machinery or equipment, power failure, natural or nuclear disaster, fire, flood, drought, adverse weather conditions, levels of water in rivers, acts of God, closure of airports, changes of schedules or operational decisions of transport providers (each such event or circumstance being defined in these Booking Conditions as a "Force Majeure Event").
(e) Travel Delays
We have included in many of our trips the services of major international airlines, and while these airlines' flights are rarely subject to lengthy delays, there are occasions when such delays do occur. Under EU law (Regulation 261/2004), you have rights in some circumstances to refunds or compensation from your airline in cases of denied boarding, cancellation or delay to flights. Full details are publicised at EU airports and are available from airlines. However, reimbursement in such cases does not automatically entitle you to a refund of your holiday cost from us. Your right to a refund or compensation is set out in clause 8(a)-(d) above. If any payments to you are due from us, any payment made to you by the airline will be deducted.
9. Our Liability to You
Our obligations and those of our suppliers are to take reasonable skill and care to provide the services or facilities that form part of your booking with us.
If any of the travel services included in your trip are not performed in accordance with your booking, we will offer you an appropriate reduction in the price for the period during which they were not, unless we can show that the problem was attributable to you. Where you suffer damage as a result, we will also offer you appropriate compensation without undue delay, subject to the exclusions set out below.
We arrange hotels and other tourist services included in your trip with local suppliers who may themselves engage the services of local operators. Standards of hygiene, accommodation and transport in many countries where we organise trips are often lower than comparable standards in the UK. We will, at all times, endeavour to appoint reputable suppliers. The terms and conditions of hotels and other providers will be applicable and are expressly incorporated into the contract. These may limit or exclude their liability. Local standards of the relevant country will be relevant in assessing the performance of the services being performed in that country.
Our liability, except in cases involving death, illness or injury, damage caused intentionally or through negligence, or cases subject to the international conventions referred to below, shall be limited to a maximum of three times the price of your trip (not including amendment charges). We shall have no liability for any loss of business or profits, loss of use or any other consequential or indirect loss or damage.
Where we are found liable for loss of or damage to luggage or personal possessions, including money, our liability to you is limited to £1,000 per person, unless a lower limit applies under this contract or under any of the international conventions referred to below.
Our liability to you (and your party) is also limited following any relevant international convention and European Union regulations, and as if we were a carrier under the applicable conventions or laws. These conventions and rules restrict the amount of compensation that passengers can claim for death, injury, illness, and loss, damage, delay in the transportation of luggage and personal belongings. The terms of the relevant conventions and regulations are expressly incorporated into your contract, and copies of applicable agreements and regulations will be provided by us upon request. Some of the conventions and rules that may apply to your trip, without limitation, are:
- Concerning carriage by air, the Warsaw Convention 1929 (whether as amended by the Hague Protocol 1955 or the Montreal Protocol of 1999 or otherwise) or the Montreal Convention 1999 or concerning flights between the UK and any member state of the European Union, EC Regulation 889/2002;
- In respect of carriage by rail, the Berne Convention 1961;
- In respect of carriage by sea, the Athens Convention 1974 and where applicable, EU Regulation 392/2009 on the Liability of Carriers of Passengers by Sea in the Event of Accidents.
All carriage (by land, air and sea) is subject to the terms and conditions of carriage of the actual carrier. These may limit or exclude liability. These are expressly incorporated into your contract with us. We will provide copies of these terms and conditions at your request. Our obligation will not exceed that of any carrier.
We are not liable to you for (a) any failures which occur in the performance of the contract that is attributable to you or any member of your party, (b) any faults that are attributable to a third party unconnected with the provision of the services contracted for, and are unforeseeable and unavoidable; or (c) any failures that are due to (i) unusual and unforeseen circumstances beyond our control, the consequences of could not have been avoided even if we had exercised due care, or (ii) any event which we or any of our suppliers, even with all due care, could not foresee or forestall.
Flights, Delays, Cancellation and Denied Boarding
Please ensure that all your travel, passport, visa and insurance documents are in order and that you arrive in plenty of time for checking in at the airport. It may be necessary to reconfirm your flight with the airline before your departure. Please ask us for at least 72 hours before your outbound flight. It would be best to note any reference number or contact name when reconfirming. If you fail to reconfirm, you may be refused permission to board the aircraft, and you are unlikely to receive any refund.
Where a flight is changed, delayed or cancelled, or you are denied boarding of a plane for any other reason, you may be entitled to claim compensation from the airline under Regulation (EC) 261/2004. Full details are available at European airports and from airlines. You must lodge any claim for compensation under this Regulation directly with the relevant airline. We are not an air carrier and will have no liability to you concerning the above Regulation. Please note that any refund you obtain under these Regulations does not give you an automatic right to receive a refund or compensation from us. Your right to a refund or compensation is set out in section 8 above. If any payments to you are due from us, any payment made to you by the airline will be deducted.
10. If You Have a Complaint
If you have any objection or problem during your trip, please inform our representatives or the relevant supplier (e.g. your hotelier, car hire company, etc.) immediately, who will endeavour to put things right at the moment when the issue happens. If your complaint is not resolved locally, we will advise the best alternative to solve your problem. You must inform us without undue delay, taking into account the circumstances of the case, of any lack of conformity that you perceive during your trip, so that we have the chance to put it right while you are still there.
If you still need to contact us after, please write to us within 28 days of your return by emailing sales@travelfab.co.uk or writing to our Customer Services Department at Travel Fab Limited, China Works, 100 Black Prince Road, Vauxhall, London, SE1 7SJ, UK giving your booking reference, name and any other relevant information. Please keep your letter concise and to the point. If you fail to follow this procedure, we will have been deprived of the opportunity to investigate and rectify your complaint at the time the problem occurred, and this may affect your rights under this contract.
We are not a member of an alternative dispute resolution scheme, and no such scheme applies to your booking with us. If we cannot settle a complaint between us, you can take the matter to the courts, as set out in section 15 below.
11. Special Requests
Whilst we will endeavour to comply with any special requests we receive (such as specific airline seating, dietary requirements or specific rooms) and will pass any special requests to the relevant supplier, however, we are unable to guarantee compliance with such requests and are not liable for any loss suffered in the event of such requests not being complied with.
12. Excursions and Activities
Where excursions and/or activities are booked and paid for in advance as part of the trip's price and detailed on our booking confirmation, these will form part of the contract with us. We undertake to use reasonable skill and care in selecting suppliers who provide excursions and activities as part of your contract. Any excursions and/or activities that you decide to purchase at any time from a local supplier or third party once your trip has commenced will not form part of your contract with us. Your contract for such excursions/activities will be made with the relevant supplier or third party and on that party's terms and conditions. We have no liability whatsoever for the performance of that excursion or activity.
13. Event Tickets
Cancellation or curtailment of a major event or sporting fixture is an unusual occurrence. We accept no responsibility to refund or compensate where changes to an event are made for reasons beyond our control. Every effort will be made to offer alternative arrangements, and in the unlikely event of cancellation, any refund obtained will be passed on to you.
14. Data Protection
Travel Fab Limited is the data controller of any personal information you provide, such as name, address and any special needs, health, medical, mobility or dietary requirements, under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. To process your booking and ensure that your travel arrangements run smoothly and meet your requirements, we need to use the personal information that you provide to us.
We may pass personal data on to relevant suppliers of your travel arrangements such as airlines, hotels, transport companies and local tour operators. Your personal information may also be provided to public authorities such as customs and immigration, security and/or credit checking companies, credit and debit card companies and government and enforcement agencies if required by them or as required by law. We may also use your personal information to carry out security checks. Your personal information may be shared with the police or other law enforcement or crime prevention agencies for security purposes.
If you travel outside the UK, your personal information may have to be sent outside the UK, where controls on data protection may not be as strong as the legal requirements in this country. This may also apply to any sensitive information that you give to us, such as details of any disabilities or dietary/religious needs. If we cannot pass this information to the relevant suppliers, whether in the UK or not, we cannot correctly affect your booking. In making this booking, you consent to this information being passed on to the relevant persons.
If you travel to or through the US, the US Customs and Border Protection will receive this information to prevent and combat terrorism and other transnational serious crimes. International travellers who are seeking to travel to the US under the Visa Waiver Programme (VWP) are now subject to enhanced security requirements and will be required to complete an ESTA (Electronic System for Travel Authorisation) 72 hours before departure and pay an administrative fee. This can be achieved on the following website: https://esta.cbp.dhs.gov.
The personal information that you provide to us or which is obtained through your dealings with us will also be used by processors or by us on our behalf: to review your transactions with us, including your purchasing and preferences; to evaluate, develop and improve the trips and services that we offer; for market research purposes and statistical analysis.
We may wish to contact you by post, email and/or telephone with news, information and offers. 15. Jurisdiction
This contract is governed by English law and is subject to the jurisdiction of the English courts. You may, however, choose the law and jurisdiction of Scotland and Northern Ireland if you wish to do so.
16. Documentation
We will send your booking confirmation and your ATOL Certificate within three days of receiving your payment. The confirmation sets out the lead passenger, the flight times, flight numbers and airline, the departure and arrival airports, the name and location of your accommodation, your other ground arrangements such as transfers, car hire, tours and entrance tickets, the total price of the package, and the unique reference number of your ATOL Certificate. If any of these change we will send you a revised confirmation as soon as we can.
We will endeavour to send your tickets, hotel vouchers and final information regarding your trip approximately two weeks before departure either by First Class post or email. Once documents leave our offices, we will not be responsible for their loss unless we are negligent. If tickets or other documents need to be reissued, you must pay all costs.
17. If You Are in Difficulty
If you find yourself in difficulty during your trip, contact us and we will give you appropriate assistance without undue delay. That includes telling you where to find health services, local authorities and consular help, making phone calls and sending emails on your behalf, and helping you find alternative travel arrangements. Our 24-hour contact details are in section 27 below.
Where the difficulty was caused deliberately by you, or through your own negligence, we may charge a reasonable fee for that assistance. Any such fee will not be more than the costs we actually incur.
18. Delayed Return
If it becomes impossible for you to return home on your planned return date because of unavoidable and extraordinary circumstances, we will arrange and pay for the accommodation you need for up to three nights per person. Where we can, that accommodation will be of a standard comparable to the accommodation in your package. Unavoidable and extraordinary circumstances include war, terrorism, a serious outbreak of disease at your destination, and natural events such as floods, earthquakes, or weather that makes it impossible to travel safely.
The three-night limit does not apply to a person with reduced mobility as defined in Article 2 of Regulation (EC) 1107/2006, or to anyone accompanying them, nor to pregnant women, unaccompanied minors, or anyone who needs specific medical assistance, provided you told us about the need at least 48 hours before departure.
19. Health, Fitness and Risk
Some of our trips involve walking at altitude, small boats, long road transfers, or physically demanding excursions, and some take place in remote areas where medical help is further away than it would be at home. It is your responsibility to make sure you are fit enough for the activities you choose, and to speak to your doctor first if you are unsure.
Please tell us when you book about any medical or physical condition, disability, or accessibility need affecting you or anyone in your party, so that we can tell you honestly whether a trip suits you and arrange what we can. If we or our local suppliers reasonably believe that taking part in an activity would put your health at risk, we may decline to let you take part, and we will not be liable for any loss that follows. If you tell us about a condition only after booking and we cannot reasonably accommodate it, we may have to treat the booking as cancelled by you, and the cancellation charges in section 7(b) will apply.
20. Your Behaviour
You are responsible for your own behaviour and for that of everyone in your party, and for any loss or damage you cause. Where damage occurs you must pay for it locally at the time, or reimburse us afterwards, together with any costs we reasonably incur as a result.
We, or our suppliers, may end your arrangements if in our reasonable opinion your behaviour is dangerous, or is causing or likely to cause distress, damage or serious annoyance to others. If that happens we will owe you no refund and no compensation, and we will not be responsible for the cost of your journey home.
21. Local Standards, Charges and Taxes
The health and safety standards that apply to your trip are those of the country you are travelling in, not those of the United Kingdom. They are different, and in places they are lower. We choose our suppliers carefully with that in mind.
Some costs are payable locally rather than to us, for example tourist and departure taxes, national park or reserve fees where we have said they are not included, minibar and room service, optional treatments and activities, and tips. We tell you what your package includes before you book, and we will tell you about the local charges we know of.
22. Foreign Office Travel Advice
The Foreign, Commonwealth and Development Office publishes travel advice for every country we sell. Please read it before you book and again before you travel: gov.uk/foreign-travel-advice.
If the FCDO advises against all travel to your destination we will normally have to cancel your trip, and we will offer you an alternative or a full refund of everything you have paid. If it advises against all but essential travel we will not usually cancel. We will tell you plainly what we think the risks are, and the decision will be yours, with the cancellation charges in section 7(b) applying if you decide not to go. Please also check how your insurer treats FCDO advice, because policies differ on this.
23. Seasonality and Maintenance
Latin America has real seasons, and we would rather tell you about them than pretend otherwise. Outside the busiest months some excursions, pools, restaurants and hotel facilities may not run, either because of the weather or because there is not the demand for them. Hotels also carry out maintenance and refurbishment, usually in the quieter months, which can put a facility out of use for a while. In the busiest weeks the same hotels run full, which makes them livelier and can make service slower.
Where something was never part of what you booked, we cannot offer a refund or compensation if it turns out to be closed or unavailable. Where we did specifically include something in your itinerary and it is not provided, that is a different matter and is dealt with under section 9.
If a facility matters to you, please tell us before you book and we will check whether it will be running at the time you travel, and say so honestly if it will not.
24. Baggage Allowances
Baggage allowances are set by the airline, not by us, and airlines change them. What you are allowed to carry, what it weighs, and what you will be charged for anything extra are matters between you and the airline, and they vary between the airlines on a single itinerary. Internal flights within Latin America often allow considerably less than the long-haul flight that got you there.
Unusual or bulky items such as bicycles, surfboards, diving equipment, golf clubs and musical instruments are usually charged separately and sometimes need to be booked in advance. Please check directly with each airline before you travel, and tell us if you are bringing something of this kind so that we can flag anything we know about.
We cannot accept responsibility for charges an airline makes for baggage, or for an airline refusing to carry an item, and these charges are payable by you.
25. Independent Arrangements
You may choose to book things yourself alongside the trip we arrange, for example an extra night either side, a connecting flight, a transfer, or an excursion booked locally. Those arrangements are not part of your contract with us, they are not covered by our ATOL licence, and we are not responsible for them or for anything that follows from them.
Please take particular care with connecting travel you book yourself. If our arrangements change, or a flight in your package is delayed, we will do what we can to help, but we cannot cover the cost of separate travel you lose as a result.
Tell us what you are planning and we will tell you honestly whether the timings look sensible.
26. Signing Documents Locally
You may occasionally be asked to sign a form before an activity, most often for adventure activities such as rafting, diving, riding or trekking. Please read anything you are asked to sign. Be careful of any document that asks you to give up your rights, or that tries to absolve the local operator of responsibility for its own negligence, because signing it may affect both your legal rights and your travel insurance.
You are not obliged to sign anything of that kind. If you are asked to, and you are unsure, please contact us using the 24-hour details in section 27 below before you sign.
